General Terms and Conditions Wasdroom
1. General
1.1. These general terms and conditions apply to all offers, orders, agreements, and giveaways from Wasdroom, located at De Tongelreep 1, 5616 AJ Eindhoven, registered with the Dutch Chamber of Commerce under number 80121381, hereinafter referred to as “Wasdroom.”
1.2. By placing an order or participating in a giveaway, you acknowledge that you agree to these general terms and conditions. Wasdroom reserves the right to amend these terms after the expiration of their term.
2. Offers and agreements
2.1. All offers from Wasdroom are non-binding. An agreement is concluded after your order is accepted by Wasdroom.
2.2. Wasdroom reserves the right to refuse orders or assignments without stating reasons or to attach special conditions to the delivery.
3. Prices and payment
3.1. All listed prices are in euros, including VAT and excluding shipping costs, unless stated otherwise or agreed upon in writing.
3.2. Payment must be made within 14 days from the invoice date, unless otherwise agreed. If the payment term is exceeded, you are legally in default, and Wasdroom is entitled to charge statutory interest and extrajudicial collection costs.
4. Delivery
4.1. Wasdroom aims to deliver products within 5–10 working days after receipt of the order, unless another delivery time has been agreed.
4.2. If the delivery time is longer than indicated, you will be informed in time and have the right to cancel the order free of charge.
5. Returns and right of withdrawal
5.1. You have the right to cancel your order up to 30 days after receipt without giving any reason. After cancellation, you have another 30 days to return the product.
5.2. Upon return, you will receive a full refund of the order amount, excluding shipping costs. The return shipping from your address to Wasdroom is free of charge.
5.3. If the product is not in its original packaging or is damaged, a depreciation may be charged.
5.4. Wasdroom will refund the order amount within 14 days after notification of your return, provided the product has been received in good condition.
6. Warranty and complaints
6.1. Wasdroom guarantees that the delivered products meet normal standards and are free of defects.
6.2. Complaints regarding the execution of the agreement must be submitted within 7 days, clearly described and sent to info@wasdroom.com.
6.3. Wasdroom will respond to complaints within 14 days of receipt. If a complaint requires a longer processing time, you will receive a confirmation of receipt within 14 days with an indication of the expected resolution time.
6.4. In case of disputes, you may contact the European ODR platform via https://ec.europa.eu/consumers/odr or request mediation via WebwinkelKeur at https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil.
7. Liability
7.1. Wasdroom is not liable for damage resulting from the use of the product, unless there is intent or gross negligence on the part of Wasdroom.
7.2. Wasdroom is never obliged to pay compensation to the buyer or third parties, except in cases of intent or gross negligence.
8. Force majeure
8.1. Wasdroom is not obliged to fulfill obligations towards the buyer if hindered by circumstances beyond its control and which cannot be attributed to Wasdroom under the law, legal acts, or generally accepted practice.
9. Applicable law and disputes
9.1. All legal relationships involving Wasdroom are governed exclusively by Dutch law.
9.2. Disputes will be submitted to the competent court in the district of Eindhoven, unless otherwise prescribed by mandatory law.
10. Giveaway organizer
10.1. The giveaway is organized by Wasdroom, located at De Tongelreep 1, 5684 PZ Best, registered with the Dutch Chamber of Commerce under number 80121381, hereinafter referred to as the "Organizer."
11. Participation in the giveaway
11.1. Participation in the giveaway is open to individuals aged 18 and over, residing in the Netherlands, unless otherwise stated.
11.2. Participation is free of charge and takes place by fulfilling the action conditions as specified in the giveaway announcement (e.g., posting a photo, following an account).
11.3. Employees of Wasdroom and their direct family members are excluded from participation.
12. Permission for use of photos
12.1. By participating in the giveaway, the participant grants Wasdroom permission to use submitted photos, videos, or other shared materials for marketing and promotional purposes, including but not limited to publication on social media, websites, and other Wasdroom communication channels.
12.2. The participant declares that they are entitled to share the submitted materials and that they do not infringe on the rights of third parties, such as copyright or portrait rights.
12.3. Wasdroom reserves the right to use, edit, or remove submitted materials at its discretion without prior notice.
13. Giveaway prizes
13.1. The prize of the giveaway is described in the announcement of the action. Prizes cannot be exchanged for cash or other goods.
13.2. Wasdroom determines the winner(s) based on the specified conditions. The result is final and not subject to correspondence.
14. Giveaway liability
14.1. Wasdroom is not liable for any damage or injury resulting from participation in the giveaway or use of the prize.
14.2. Wasdroom reserves the right to change, suspend, or terminate the giveaway at any time without stating reasons.
15. Giveaway privacy
15.1. Personal data of participants will be processed in accordance with the General Data Protection Regulation (GDPR).
15.2. Participants agree that their name and/or submitted materials may be made public in connection with the giveaway.
16. Applicable law for the giveaway
16.1. Dutch law applies to the giveaway and these general terms and conditions. Disputes will be submitted to the competent court in the district of Eindhoven.
